Texas Commission on Environmental Quality (TCEQ) Construction General Permit

TCEQ reissued the Construction General Permit (CGP) TXR150000 with an effective date of March 5, 2018. The general permit authorizes the discharge of stormwater runoff associated with small and large construction sites and certain non-stormwater discharges into surface water in the state.

Under the CGP, construction activities from which runoff goes into or adjacent to any surface water in the state are regulated according to the area of land disturbed.

  • Large construction activities which disturb five or more acres, or are part of a larger common plan of development that will disturb five or more acres, are regulated under this general permit.
    • Construction site operators must develop a Stormwater Pollution Prevention Plan (SWPPP) and submit a copy of their Notice of Intent to the City of Denison at least two days prior to excavation.
  • Small construction activities which disturb at least one but less than five acres are also regulated under this general permit.
    • Construction site operators must develop a Stormwater Pollution Prevention Plan (SWPPP) and post a Construction Site Notice at least two days prior to excavation.
  • Construction activities that disturb less than one acre and are not part of a larger common plan of development that would disturb one or more acres are not required to obtain coverage under this general permit but, are encouraged to prepare a limited pollution prevention plan.
